Land Division & Property Splits

Dividing a parcel legally in Michigan — survey, new legal descriptions, and the municipal and county review that makes the split recordable.

Overview

What a Land Division & Property Split actually involves

Splitting a parcel in Michigan is a legal process, not just a line on a drawing. Under the state's Land Division Act, a division has to be approved by the municipality before the new parcels can be conveyed — and approval depends on each resulting parcel meeting frontage, depth, access and zoning requirements.

We survey the parent parcel, design divisions that will actually clear review, prepare the legal descriptions for each new parcel, and carry the application through the assessor and the municipality. Getting this wrong creates unbuildable parcels and title problems that surface years later at closing.

Typical triggers

01

Selling off part of a parcel

The buyer cannot take clear title to a piece that has not been legally divided.

02

Family land transfers

Splitting acreage between family members still requires formal division approval.

03

Development phasing

Creating sellable or financeable parcels ahead of construction.

04

Correcting an old split

Informal historic divisions frequently fail to survive title review.

Questions

Land Division & Property Splits FAQ

Michigan's Land Division Act allocates a limited number of divisions to a parent parcel based on its size and history, and some of that allowance may already have been used by previous owners. We check the division history as part of the work, before you plan around an allowance you may not have.
Yes. A division has to be approved by the municipality before the new parcels can be conveyed. We prepare and carry the application, and we design the split to meet the local requirements rather than submitting something that will be rejected.
Most Michigan municipalities require frontage on a public road, or a legally documented access easement. If the split you want creates a landlocked parcel, we will tell you at the outset and set out what access documentation would be needed.
